This User Agreement ("Agreement") governs your access to and use of the EchoMyMood mobile application and related services ("EchoMyMood," the "App," the "Service," "we," "us," or "our").
By creating an account, accessing, or using EchoMyMood, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree with these terms, please do not use the Service.
EchoMyMood is a personal journaling, mood tracking, habit tracking, and self-reflection application.

If you are under the age required to independently consent to data processing or enter into this Agreement under applicable law, you may use EchoMyMood only with the involvement and authorization of a parent or legal guardian where required.
You may not use EchoMyMood where applicable law prohibits you from doing so.

You are responsible for activity conducted through your account except where such activity results from circumstances outside your reasonable control.
EchoMyMood allows you to create and store personal content, including journal entries, reflections, mood information, habit information, photos, tags, and other content you voluntarily provide ("User Content").
You retain ownership of your User Content.
By submitting User Content to EchoMyMood, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, and display such content only as reasonably necessary to provide, maintain, and secure the Service.
We do not claim ownership of your journal entries, photographs, or personal reflections.
You are responsible for ensuring that you have the necessary rights to any content you upload or otherwise provide through the Service.

EchoMyMood is designed for personal organization, journaling, mood tracking, self-reflection, and habit tracking.
The Service is not a medical, psychological, psychiatric, therapeutic, counseling, or emergency service.
Mood records, habit records, historical trends, reminders, and other information displayed by EchoMyMood are intended for personal tracking and self-reflection purposes only.
EchoMyMood does not provide:

If you are experiencing an emergency or believe that you or another person may be in immediate danger, contact the appropriate local emergency service or qualified professional.
Certain EchoMyMood features may request access to capabilities available on your device, such as:
EchoMyMood requests access only when reasonably necessary to provide the relevant functionality.
For example, photo access may be requested when you choose to add a photo to a journal entry, and notification access may be requested when you choose to use reminder functionality.
You may grant, deny, or later revoke device permissions through your device settings.
Restricting a permission may prevent the related feature from functioning, but permissions that are not required for core functionality will not be made a condition of using unrelated features.
EchoMyMood may request permission to send notifications.
Notification permission is optional and can be managed through your device settings.
EchoMyMood currently may use local notifications scheduled and generated on your device.
These notifications may include:
Local notifications are generally scheduled and delivered by your device's operating system.
The availability, timing, and delivery of local notifications may depend on your device, operating system, notification settings, battery management settings, and other factors outside EchoMyMood's control.
We therefore cannot guarantee that every notification will be delivered at a particular time.
Future versions of EchoMyMood may introduce remote or push notification functionality.
Remote notifications may be used for:
If remote notifications are introduced, the App may need to register or process a push notification token or similar technical identifier associated with your App installation or device in order to deliver notifications.
This does not mean that EchoMyMood currently collects or processes a remote push notification token.
Any future processing associated with remote notifications will be governed by the then-current EchoMyMood Privacy Policy and applicable platform requirements.
You may disable notifications at any time through your device settings.
EchoMyMood may rely on third-party service providers where reasonably necessary to operate, maintain, secure, or support the Service.

Your use of EchoMyMood is also governed by the EchoMyMood Privacy Policy.

The EchoMyMood application, including its software, interface, branding, logos, visual elements, text, and other materials provided by EchoMyMood, is owned by or licensed to EchoMyMood and is protected by applicable intellectual property laws.
Except as expressly permitted by this Agreement or applicable law, you may not copy, modify, distribute, sell, license, or create derivative works from the Service or its proprietary materials.
This section does not affect your ownership of User Content.
If you voluntarily provide suggestions, comments, ideas, or other feedback regarding EchoMyMood, you grant us permission to use that feedback to develop, operate, and improve the Service without restriction or compensation, provided that such use does not identify you in a manner inconsistent with our Privacy Policy.
We aim to provide a reliable Service, but EchoMyMood may occasionally be unavailable due to circumstances including:

The availability and timing of reminders or notifications may also be affected by device or operating-system restrictions and cannot be guaranteed.
We may modify, update, add, or remove features from EchoMyMood from time to time.
We may also provide different functionality depending on App version, platform, region, device, or account status.
This may include introducing new notification, synchronization, or other functionality.
If a change materially affects your rights or obligations, we may provide appropriate notice where required by applicable law.
Where account deletion functionality is available within EchoMyMood, you may request deletion of your account through the App.
Upon completion of an account deletion request, we will delete or de-identify account-associated information within a reasonable period, except where retention is required or permitted by applicable law.
Certain information may need to be retained temporarily or for a longer period where reasonably necessary for:

To the maximum extent permitted by applicable law, EchoMyMood and its operators, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited under applicable law.
We may update this Agreement from time to time as EchoMyMood evolves or as legal, technical, or operational requirements change.
When material changes are made, we may provide reasonable notice through the App or other appropriate means where required.
The effective date shown at the beginning of this Agreement indicates when the current version became effective.
Your continued use of EchoMyMood after an updated Agreement becomes effective constitutes acceptance of the updated Agreement to the extent permitted by applicable law.
This Agreement will be governed by applicable law, subject to any mandatory consumer-protection rights that apply to you under the laws of your jurisdiction.
Nothing in this Agreement is intended to deprive you of mandatory rights provided by applicable law.
